Welcome to VirtuaVixen.com (“the Platform,” “VirtuaVixen,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of the Platform. By creating an account or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.
1. User Accounts and Eligibility
1.1. To use the Platform, you must be at least eighteen (18) years old, or the age of legal majority in your jurisdiction, whichever is higher.
1.2. By creating an account, you represent and warrant that you meet this requirement and that all information you provide is truthful and accurate.
1.3. You are solely responsible for maintaining the confidentiality of your account credentials and for all activity conducted under your account.
1.4. We may refuse service, suspend, or terminate accounts at our sole discretion.
2. Prohibited Conduct
2.1. Users may not:
a) Harass, threaten, stalk, or defame others.
b) Transmit spam, chain letters, or unsolicited communications.
c) Interfere with or attempt to compromise the security or integrity of the Platform.
d) Use the Platform for unlawful purposes or in violation of any applicable law.
2.2. Violations may result in immediate suspension or permanent termination of your account.
3. Content Guidelines
3.1. VirtuaVixen is dedicated to AI-generated adult content. All uploaded content must comply with the following rules:
a) No Deepfakes: Uploading, creating, or distributing deepfake content or any content depicting an identifiable real person—whether public figure or private individual—without explicit, verifiable written consent is strictly prohibited.
- VirtuaVixen bears no liability for any deepfake or unauthorized likeness uploaded by users.
- The uploading user assumes full legal and financial responsibility.
- VirtuaVixen reserves the right to terminate accounts immediately and pursue legal action against violators, including cooperation with law enforcement.
b) Permitted Content Styles: Photorealistic AI, animation, cartoon, and anime content are allowed, provided all other rules are followed.
c) Prohibited Content Styles: Furry or animal-related sexual content, bestiality, or depictions involving non-human sexual activity are strictly forbidden.
d) Adult Depictions Only: All characters in sexual scenarios must clearly and convincingly appear 18 years or older. Content suggesting, implying, or depicting minors is forbidden.
e) Non-Consensual Themes: Content suggesting non-consensual acts is not permitted.
3.2. VirtuaVixen may review, remove, or restrict any content at its sole discretion.
4. Intellectual Property Rights
4.1. Creators retain full ownership and intellectual property rights in their uploaded content (“Your Content”). VirtuaVixen does not claim ownership.
5. License Grant to VirtuaVixen
5.1. By uploading Your Content, you grant VirtuaVixen a worldwide, non-exclusive, royalty-free license to host, stream, transcode, distribute, and promote Your Content solely in connection with the operation and marketing of the Platform.
5.2. This license includes the right to place advertising with or around Your Content, with Creator payouts determined under Section 6.
5.3. The license ends when Your Content is removed from the Platform.
6. Creator Monetization and Payouts
6.1. VirtuaVixen compensates Creators using a tiered payout system with ten (10) tiers.
- Tiers are assigned at the time of account creation. Earlier Creators are placed in lower-numbered tiers, which generally correspond to higher payout levels.
- Creators may move up tiers based on performance metrics (such as views, engagement, and content quality). All tier assignments and movements are determined solely by VirtuaVixen, at its absolute discretion.
- Creators can view their current tier and payout level in their Creator Dashboard.
6.2. Payouts are made in USDT (Tether). A minimum of $25 must be accrued for payout eligibility. Balances below this amount roll over to the following month.
6.3. System-Wide Adjustments: VirtuaVixen reserves the right to apply payout adjustments that affect all tiers equally, based on total Platform view volume, to protect the financial stability of the Platform.
6.4. Rate Adjustments: VirtuaVixen may modify, adjust, or discontinue payout tiers, rates, or eligibility criteria at any time, for any reason, and without prior notice. Continued use of the Platform constitutes acceptance of such modifications.
6.5. Creators acknowledge and agree that tier assignments, payout rates, and system adjustments are not contractual guarantees. Past or current rates do not create any entitlement or expectation of future earnings.
7. Limitation of Liability
7.1. The Platform is provided “as is” and “as available,” without warranties of any kind.
7.2. VirtuaVixen does not guarantee the accuracy, reliability, or legality of user-generated content.
7.3. Users are solely responsible for the content they upload. VirtuaVixen expressly disclaims liability for any deepfakes, unauthorized likenesses, prohibited content, or illegal material uploaded by users.
7.4. In no event shall VirtuaVixen, its affiliates, directors, officers, or employees be liable for any direct, indirect, incidental, consequential, or special damages arising from your use of the Platform.
8. Termination of Accounts
8.1. You may terminate your account at any time through your account settings.
8.2. We may suspend or terminate your account immediately, without notice, for any violation of these Terms.
8.3. Termination ends your access to the Platform. We may remove or retain associated content at our discretion.
9. Copyright & DMCA Policy
9.1. VirtuaVixen respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA).
9.2. Copyright owners may submit takedown notices to our Designated Agent: copyright@virtuavixen.com
9.3. DMCA notices must include all legally required elements (signature, identification of work, infringing material, contact details, and good-faith statement).
